The Bribery Act 2010 - Key Dates Date: 23/07/2010

The Bribery Act 2010 overhauls the bribery regime in the UK and creates some significant new offences.  Of particular significance is the new offence of failure by a commercial organisation to prevent a bribe being paid for or on its behalf.  See our previous Earlywarning bulletin for more information.

Following a Ministry of Justice announcement on 20 July 2010, we now have the following key dates:

When is the Bribery Act 2010 in force?

The Ministry of Justice has confirmed that the Bribery Act will come into force in April 2011

Publication of Guidance

Commercial organisations have a defence to the corporate offence described above if they have "adequate procedures" in place to prevent bribery.  The Ministry of Justice has now confirmed that their Guidance on the sorts of "adequate procedures" which commercial organisations can put in place to prevent bribery will be published in early 2011.  The Government will launch a short consultation on the Guidance in September 2010.


Before the election, the Ministry of Justice indicated that the Bribery Act would be in force in October 2010, so implementation is later than expected.  Commercial organisations should use the additional time to review and update their compliance procedures and familiarise themselves with their anti-bribery obligations.
